Alzheimer’s Disease (AD) and Oxidative Stress Relationship Alzheimer’s illness (AD) is a neurodegenerative sickness which causes a deadly turn in the basic honesty, and a barrier in the capacity of cerebrum, this inevitably channel the circumstance to degeneration and shrinkage of mind, and supersede the control of cerebrum over different pieces of the body, and goes to the last shutting comment of the malady passing. Studies done on the subject have substantiated that the ailment isn't reversible, and the main fix of expectation is hindering its encouraging. In any case, as the ailment propels through mid stage and develops into extreme AD, the state of patient gets disgraceful and care giving turns out to be increasingly excruciating. Studies have detailed that prominent manifestations of AD are seen simply following 60 years old, despite the fact that the sickness has begun before that. Beginning indications are loss of transient memory-being neglectful about the ongoing occasions, and progressively over some stretch of time unders tanding appears to be increasingly missing â€minded about the earth, things which are artificially carved in the drawn out memory starts to be eradicated, and the last stage begins driving the patient into extreme AD which is enormously woeful. Studies have demonstrated that loss of capacity of neurons is the reason for AD. A more critical investigate the angle uncovered a perplexing arrangement of occasions that go before the neuronal degeneration-oxidative pressure and unevenness in homeostasis, development of detours in correspondence, self-destructing of uprightness and passing of neurons. This empowered to go past the discoveries of shallow investigations done and speculation created, and assisted with diving a lot further into the inward functions and component of the ailment. Speculations created to clarify component of AD are: amyloid course theory, cholinergic speculation and tau speculation. Amyloid course speculation says, APP-Amyloid Precursor Protein, a transmembrane protein engaged with fundamental jobs of development, endurance and fix of nerve cells-is cut at wrong places by a catalyst called secretase, prompting the arrangement of amyloid ÃŽ ² peptides which collects to shape plaques-amyloid plaques-and tie to neurotransmitters hindering the correspondence channel, in the end causes memory misfortune. As indicated by cholinergic theory, descending float in the degrees of acetylcholine in mind is the reason for Alzheimer’s illness. Loss of capacity of cholinergic neurons was found in Alzheimer’s malady patients. Move in the degree of acetylcholine occurs because of the absence of two catalysts associated with blend and separating of acetylcholine. This will prompt loss of capacity of neurons; brain’s usefulness self-destructs, and in the long run prompts manifestations of Alzheimer’s illness. Tau theory moves toward the issue in another point of view, tau protein-a protein related with microtubules in nerve cells- gets hyperphosphorylated, this empowers cross connecting among tau protein units, and they chill out from being appended to the microtubules. This causes loss of basic honesty of nerve cells, and they breakdown and cluster to shape tangles-neurofibrillary tangles. Studies directed concentrating on the inward activities of these theory have discovered that oxidative pressure is the explanation that improves plaque and tangle arrangement, fix instruments in cells can't settle the circumstance as the oligomer development and cross connecting are prevalently made by non peptide bonds. In another investigation, amyloid ÃŽ ² peptides have indicated close connection with certain reasons for frantic bovine sickness. Studies identified with hereditary qualities of AD have discovered the connection between APOE quality on chromosome 21 and the sickness. APOE quality codes for apolipoprotein, and one among its capacities is separating of APP. APOE has variations, APOEÃŽ µ4 is the one which cod es for less dynamic protein whose ability to separate APP is drowsy. Individuals with this variation quality are increasingly will in general grow AD in later phases of life, and any irregularity identified with chromosome 21 likewise brings about AD over some stretch of time.

FAQ Should I bring a car

FAQ Should I bring a car Hello! Most new and transfer students have many questions about what to bring to school with them. A car is something that many people may have access to at home but not at school. Im here to tell you that either way is perfectly fine! Personally, Ive been in both situations, so I understand each side. At Illinois, we are lucky enough to have classes, restaurants, shops, and recreation all within walking distance. If it is cold or rainy or you just dont feel like walking, the MTD bus system is excellent. Depending on where you live, a bus stop is always pretty close. There are a few apps you can download on your phone to track the bus times. Having a bike is also a great alternative to walking or driving. There are so many options without a car, and Im glad that I experienced campus without one. I  appreciate walking way more now and got in a little exercise on top of that. If you do decide to bring a car, make sure you have a parking spot secured. Parking can be a challenge  on and around campus, as many parking spots are rented out or metered. Most apartment buildings and residence halls will have parking spots nearby that you can rent. While having a car can be convenient, there are also some downfalls. You will most likely always need quarters for meters, and driving on campus can be difficult at first. However, having a car is great if you need to go grocery shopping or have a job off campus. Whatever you decide to do is ultimately up to you! However, it is good to know that you will be successful with or without a car at this university. Have a great day! -Alex Alex Class of 2017 My major is Social Work and I love every minute of it. I grew up in a really small town called Braidwood, Illinois. Before I attended the University of Illinois, I went to Joliet Junior College.

Holocaust Diaries - Free Essay Example

Over the past decade, moral, political and legal philosophers around the world became increasingly interested in understanding the concept of evil. The ascriptions of evil motivated this by journalists as they attempt to comprehend and respond to various atrocities and horrors of the past, Holocaust, and killing sprees by killers. Today, it is difficult to capture the moral significance of these acts, and their perpetrator by calling them wrong. A concept of evil is therefore, needed. In understanding the concept, an emphasis is kept on the actions and words of the wrongdoers of the Holocaust. This is found from the documents in the Third Reich since the victims had a lot to talk about the evil deeds and actions. The paper will, therefore, focus on the Jewish diaries that were written in the midst of the Holocaust to reveal the concept of evil. Our initial focus is on the Holocaust diaries is that of Adolf Guttentag. In his seventies, Adolf lived with his wife Helena in Berlin. He fled to the United States during the onset of war in Germany in 1939. However, there was a deportation program in the country. This was a move by the Nazi authorities who were deporting all the Berlin Jews. Adolf had a diary that recorded his thoughts during the entire period. Adolf wrote the diary with the aim of communicating to his son Otto who was living in San Francisco. Typically, the journal connotes emotional instances of the effects the Nazi authority had on the German Jews during the period. Adolf through the diary condemned the deportation by the Nazi authority as he claims it would take them to an overcrowded and unhygienic ghetto. Adolf was hoping that he was exempted from the deportation that his Jewish friends and families were going through. However, the pressure was too much for Adolf and his wife until when they decided to take their life by committing suicide. His diary dramatically fits into the Holocaust diaries as evil activities prevail all through leading to his death. The log is also related to many of the Holocaust diaries whe re immoral actions cause individual to make dangerous decisions in life. Another Holocaust diary is of Abraham Frieder. He was born in 1911 and died in 1945. He was an orthodox rabbi in Nove Mesto Nad Vahom, a place that was later named new Slovak. As a leader, Abraham worked hard to improve a lot of the countrys Jews. Abraham in his diary recorded an attempt negotiation and bribe to the Nazi authority to stop the deportation program that was initiated. The diary provides an insight into the early response of Jewish leaders in Slovakia to the first news of the upcoming deportation. The diary also recounts the period in which the working group to deport individuals originated. However, several people, that were mentioned in Abrahams diary we see them become prominent members of the working group. Despite surviving from the war, Frieder later died after the liberation. During the movement, Abraham indicates in his diary that at least 60, 000 Jews by 1942 had been deported through camps in Slovakia to the Reich where they were later all murdered in cold blood. Comparable to other Holocaust diaries, Abraham Frieders logs recorded a live event that occurred. It indicates a historical background full of war and other disputes. Abraha m, therefore, wrote the diary to indicate the attempt made in putting to an end the evil act of deporting and killing innocent individuals.Herzl Mazia is another prominent individual who was a Palestinian Jew enrolled in the British army. He was also among the force that occupied Libya in the aftermath of the victory over the axis power in North Africa. Unlike other Jewish diaries, Mazias diary is merely a combination of a travelogue and more mundane topics ranging from contemporary cinema to Jewish life post-axis North Africa. He wrote the diary mainly to document the good memories he had during his time in the air force. Herzl Mazia wrote the diary while on his trips under the air force in Libya and North Africa. Compared to other Holocaust diaries, Mazias journal was mainly for his memory. From the journal, it has established that Libya was a territory key to the Italian imperial project from its pre-fascists years. Still, the wicked act of deportation still prevails in his diary as he indicates the deportation of Elvira Kohn to the island of Rab found in North Africa. Generally, the primary audience of this journal was his family, where he was trying to show them the memories and experience he had from different places around the world. From the journal, the audience learns the real picture of the Holocaust diaries where the evi l activities in the past were not of the concern of many individuals but only to the affected.Moryc Brajtbart was from Poland and together with his family were displaced from the country when Germany invaded Poland. At this time, Moryc Brajtbart was only seventeen years old. During their transportation, together with his uncle and cousin, they managed to jump off the transportation track and established a refuge in the nearby Zelow. According to Moryc Brajtbart, the condition there were much better compared to their native land. While in Zelow hiding, his uncle and cousin were killed and therefore he decided to seek refuge at a different place. He then wrote the diary while a refugee is encompassing the awful events that were happening. The log contained the description of the event, from the invasion of Germany to Poland to his final refuge destination. However, he does not provide the information about his life in hiding, and the audience barely learns about Genia. The most robust motifs in his diary are the different nightmarish dream sequence. From ones perspective, Moryc Brajtbart wrote the diary to explain to the audience the challenges individuals undergo when faced with different situati ons and while under refuge. Moryc Brajtbarts diary depicts a historical background surrounded by war and conflict among communities. Finally, Saartje Wijnberg was Dutch Jewish citizen from Groningen whose diary was documented among the Holocaust diaries. Like any another individual, Saartje Wijnberg was deported from her native land to Sobibor back in 1943 while she was 21 years old. At the moment, Sobibor was regarded as a killing center founded for the operational Reinhardt. The chances of survival were limited, and therefore Saartje Wijnberg and the husband plotted a way to escape. They managed to escape the death and seek refuge in a camp. It is here that Saartje Wijnberg decided to write a diary explaining the challenges one faces while in the camp. Saartje Wijnberg through the diary illustrated the intricacy of authorship and drawing its precise moments. In 1944, Saartje Wijnberg was pregnant and therefore recorded entries in her journal indicating the experience women underwent while in hiding. The diary target women within the society. Finally, the journal fits into the Holocaust Diaries since it was recorded while the writer is in a different situation. In conclusion, every society today is indeed surrounded by evil activities. As documented in the Holocaust Diaries, the actions often cause some psychological torture to the victims. In this concept, the Holocaust diaries help in the understanding of the evil actions with war and challenges faced by refugees prevailing all through. According to the writers mentioned, conflict within the community was the significant hurtful act that was experienced in the past. Majority of the individuals were displaced from their home of a resident. As a result, they were often left with no alternative but to seek refuge in their neighborhood. However, they were still followed and killed while in the camps. This cause some such Adolf Guttentag to commit suicide. The Jewish diaries during the Holocaust period are indeed significant to our understanding of the past events and the effects of the events. The diaries generally convey a similar theme of war in society and challenges of refugees.

How to Make Instant Snow From Boiling Water

You probably know that you can make snow using a pressure washer. But did you know that you can also make snow from boiling water?  Snow, after all, is precipitation that falls as frozen water, and boiling water is water that is on the verge of becoming water vapor. Its incredibly easy to make instant snow from boiling water. All you have to do is follow these steps: Materials You need only two things to turn boiling water into snow: Freshly boiled waterReally cold outdoor temperatures, around -30 degrees Fahrenheit Process Simply boil the water, go outside,  brave the frigid temperatures, and toss a cup or pot of boiling water into the air. Its important that the water be as close to boiling and the outside air be as cold as possible. The effect is less spectacular or wont work if the water temperature drops below 200 degrees or if the air temperature climbs above -25 degrees. Be safe and protect your hands from splashes. Also, dont throw the water at people. If it is sufficiently cold, there shouldnt be a problem, but if your concept of the temperature is mistaken, you could end up causing a dangerous accident. Always be careful when handling boiling water. How It Works Boiling water is at the point of changing from a liquid into water vapor. It has the same vapor pressure as the air around it, so it has plenty of surface area to  expose to a freezing temperature. The large surface area means its much easier to freeze the water than if it were a liquid ball. This is why its easier to freeze a thin layer of water than a thick  sheet of water. Its also the reason youd freeze to death more slowly curled up into a ball than if you were to lie spread-eagle in the snow. What to Expect If you want to see boiling water turn into snow before you attempt this experiment, view a demonstration on the Weather Channel. The video shows a person holding a pot of boiling water and then tossing the scalding liquid into the air. An instant later youll see a cloud of snow crystals falling to the ground. I could watch this all day, the announcer says as she introduces the video, which was shot at  Mount Washington, New Hampshire, the highest mountain in New England. The announcer notes before the video begins that the snow-making folks performed the experiment three times—once with a measuring cup, once with a mug, and once with a pot. Ideal Conditions In the demonstration video, the temperature of the water was 200 degrees and the temperature outside was a frosty -34.8 degrees. The experimenters said that they had diminished success when the water temperature dropped below 200 degrees and when the outside temperature rose above -25 degrees. Of course, if you dont want to go through all of this and you still want to make snow, or if the temperature outside  is just too warm, you can  make  fake snow  using a common polymer while staying warm and toasty indoors.

The Benefits Of Steam Education - 1122 Words

By incorporating these types of art into STEM classes, teachers allow students to improve in both academic and nonacademic abilities. One of the biggest benefits of STEAM education is that it allows for more innovation and competition, which would help the United States grow in comparison to other countries. The problem solving and critical thinking skills used in the arts will allow the country to continue innovating and help the economy grow. The arts are a necessary component for innovation to occur (Wynn Harris, 2012) because they allow for the increased creativity that is needed for innovation. As the job market shifts its emphasis to service-oriented jobs, it is important that the future workforce have strong creativity, imagination, and ideas (Brezovnik, 2015), all of which are fostered through art. According to John Maeda (2013), the arts have as much power as STEM subjects do for distinguishing America from global competitors, and STEAM can even enhance America’s economic competitiveness (Adding Arts to Stem, 2012). STEAM specifically is important for increasing innovation because it shifts STEMâ⠂¬â„¢s focus on scores to a focus on interdisciplinary learning and an understanding of the material, which will develop a more innovative future workforce (Watson Watson, 2013). Beyond helping students understand other subjects, develop other important skills, and grow in motivation and self-expression, the arts allow students to become more innovative for the future. Essay on The Impact of Absent Fathers - 1614 Words

Absent Fathers Rough Draft For various reasons, many children in the United States are living without their fathers in their homes or absent from their lives entirely. This is an issue all across the world and the children are having to deal with the disadvantages caused by the lack of support from their fathers. This issue has a significant effect on society and can be viewed and interpreted from the three sociological perspectives. As a result of many studies, it was found that children raised in father absent homes almost universally experience disadvantages such as: worse health, poorer academic achievement, and a less enjoyable educational experience. There are many variables that need to be taken into effect when considering†¦show more content†¦63 percent of households with an income of $25,000 or less are fatherless, and only 18 percent of households with an income of $75,000 or higher. Almost identical statistics apply to less than high school credentials versus a bachelor’s or graduat e education. 62% of parents that have less than a high school education are raising children without their father, and only 22% of parents with a bachelor’s degree and 18% of parents with a graduate degree are living in the same situation (DeBell 2008.) A correlation can be drawn here between education/income and percentage of fatherless households. Generally speaking, as education increases, so will income. As income increases, the percentage of fatherless children and households decreases. However, it could be argued that the income of the household will decrease when the father is gone and not contributing to the finances. Though children without their fathers may not always be disadvantaged by his absence, statistics clearly show that as a whole, children in America are not benefitted by the lack of a father. The same study conducted in 2003 showed that academic achievement is largely affected by fatherlessness. Seven percent of children living with their father have ever repeated a grade in school, that number raises to sixteen percent in children without their father. 49 percent of childrenShow MoreRelated The Impact of Absent Fathers in Black Female Upbringing Essay1986 Words   |  8 Pagestheir fathers during crucial developmental ages, the rate of our young black girls growing up without fathers is staggering and overlooked. Finally, in old ages 8 and 9 students are expected to do usage of sample infinite diagrams, therefore supplying another graphical word picture of the chances of given results. Give students a choice of statements on cards and inquire them to sequence on a chance continuum such as this Sequencing events harmonizing to their chance can reenforce the utility of the chance line every bit good as stimulating treatment about the comparative opportunity of different events. The chance of acquiring at least one six when two dies are thrown The chance of acquiring a multiple of 3 when one die is thrown The chance of acquiring a tail and two caputs when three coins are flipped Impossible Unlikely Likely Certain 0 1 The undertaking gives pattern in measuring an consciousness of the results which are possible in each context. Students may take to cipher or may wish to exemplify some of the results. Either will assist to warrant their ranking of the events relative to one another. We are sometimes expected to appreciate the opportunity of one event relation to the opportunity of another, rather different event, for illustration, ‘You are more likely to decease traversing the route thanaˆÂ ¦ ‘ Matching Associating different fortunes to a given chance is an activity based around the figure and coloring material of otherwise indistinguishable counters in a bag. This engages students in working out the possible figure and scope of colors of counters in a bag given a certain chance such as those shown below. Initially the work is in braces traveling to larger groups to portion thought. P ( Red ) = A? P ( Red ) = 1/2 and P ( Blue ) = A? P ( Red ) = 1/2 and P ( Blue ) = 1/4 P ( Blue ) = P ( Green ) P ( Blue ) = P ( Red ) and P ( Green ) = 1/2 P ( Red or Green ) = 2/5 P ( Yellow ) = 1/2 and there are 6 ruddy counters P ( Red ) = 3/7 and P ( Green ) = 1/3 P ( Green ) = 1/4 and there are at least 8 xanthous counters Together students should seek to happen as many ways as they can of reacting to the undertaking, discoursing consequences as a whole category with students taking on a critical function to spot similarities and differences between the solutions and to infer the of import characteristics of the counters in the bag in order to fulfill the given chance. In other words, the joint thought gives them the chance to generalize the solutions. To simplify the undertaking, the figure of possible colorss could be limited. To widen it, see giving the chance of an event non happening, for illustration P ( non Red ) = A? P ( Pink ) = 1/5 and there are 4 different colorss Which chair: trees to grouping subdivisions. This is a simple scenario which produces some unexpected consequences and so promotes farther believing about ciphering combinations of results. One student sits on the in-between chair of a row of seven: an indifferent coin is flipped a caput means move one chair to the left a tail means move one chair to the right. Repeat the procedure twice more. Pupils work in braces to reply the inquiry: How many of the chairs is it possible to complete on after the three somersaults of the coin? A ‘tree diagram ‘ could be used to construct on the motion and visual image to place all possible sets of motion. It is interesting to discourse with students how the two signifiers of diagram both illustrate different facets of the job ; see Resource sheet: Which chair? on page 67. The ability to happen and enter all possible results for consecutive events or a combination of two or more experiments is indispensable if students are to understand, happen and utilize chances or estimations for chances in more complex state of affairss Using a chance fact Two bags A and B contain indistinguishable coloured regular hexahedrons. Each bag has the same figure of regular hexahedrons in it. An experiment consists of taking one regular hexahedron from the bag. The chance of taking a ruddy regular hexahedron from bag A is 0.5. The chance of taking a ruddy regular hexahedron from bag B is 0.2. All the regular hexahedrons are put in an empty new bag. What is the chance of taking a ruddy regular hexahedron out of the new bag? Students should separately compose down a ‘gut ‘ response and so compare their replies in little groups. The usage of specific illustrations to reply the above will be utile but students need to portion these and be encouraged to generalize. What happens if the chance of picking a ruddy regular hexahedron is the same for both bags? What happens if you change the chance of picking a ruddy regular hexahedron from each bag? What happens if you change the figure of ruddy regular hexahedrons in one bag? In both bags? All phases of this job demand that pupils place the facts environing a state of affairs. It has the possible to uncover misconceptions around chances of related events and offers the chance to generalize an result where the intuitive response is frequently wrong. Personal Learning and Thinking Skills ( PLTS ) : The Leading in larning programme has been developed as portion of the National Strategies Secondary support for whole-school betterment. My strategy of work is intentionally structured so that students look beyond capable confines to believing and larning more by and large. There is a focal point on specific believing abilities and to promote systematic development of believing accomplishments and transportation of larning across topics and to other facets of students ‘ lives. A cardinal apprehension of chance makes it likely to understand everything from bowling norms in cricket to the conditions study or your opportunities of being affected by snow! Probability is a important country in mathematics because the chance of Particular events go oning or non go oning can be critical to us in the existent universe. Today the Probability theory used to do intelligent determinations in economic sciences, Management, Operation Research, Sociology, Psychology, Astronomy, Physics, Engineering, and Genetics where hazards and uncertainness are involved to pull a decision about the likeliness of events or values. Here are given some illustrations of chance: – What are the opportunities that England Cricket squad will win the series? A A What is the Probability that it will rain tomorrow? What is the chance about stableness in Gas monetary values in following month? Planing for inclusion: Show how your strategy of work programs for inclusion vitamin E ) Appraisal With Increased attending being paid to the consequences of national trial and external scrutiny statistics being published to measure the public presentation of schools, the possible value of appraisal for student is frequently overlooked. All excessively frequently assessment is seen as an impersonal, formal procedure which is done to students. Their advancement is measured, attributed a class or mark, and this is so reported to others the appraisal procedure appears to hold small value for the pupils themselves. However, if appraisal is to heighten larning so its formative intents must be emphasized. The students need to appreciate how the appraisal may lend to their acquisition and go involved in moving on the information which the appraisal has provided. My chief concern in measuring my students ‘ acquisition was the advancement of my efficaciousness in learning the subject. My appraisal, hence, needed to be effectual and consistent with the outlooks of student acquisition. Therefore Is have chosen formative appraisal as this would better kids ‘s acquisition. â€Å" The alone characteristic of formative appraisal is that the assessment information is used by both teacher and students to amend their work in order to do it more efficient. There is small point in roll uping information unless it can be acted upon, and since assessment information is certain to uncover heterogeneousness in the acquisition demands of a category, the action needed must include some signifier of differentiated instruction. † ( Professor Paul Black, 1995 ) My formative appraisal of my students ‘ advancement would include: Appraisal of descriptions and accounts given by students in both unwritten and written work. The medium for this appraisal would include mental maths, inquiries in category, category exercisings, prep and Plenary. Homework was set every Friday and collected in on Monday. As Tanner and Jones reference â€Å" Teachers appraisal of pupils work is basically an on-going and informal activity dwelling of inquiring inquiries, detecting activities or measuring advancement. For such appraisal to be formative there must be feedback into the learning procedure. † Therefore all the prep books were marked and given feedback on: A class, harmonizing to schools prep marker policy A general remark ( e.g. ‘untidy work ‘ ) An direction ( e.g. , ‘show your workings ‘ ) A specific marks which indicates what needs to be done following in order to better ( e.g. , ‘revise your 8x tabular array ‘ ; ) Correction of mistakes ( e.g. , in computation, spelling, method ) 2. Appraisals of single ‘s public presentation in pair/group work or whole category activities or treatment. This would be assessed harmonizing to: a ) Shared communicating which reflects student ‘s assurance with chance B ) Understanding of the job which reflects on the degree of the work ( utilizing traffic light signal ) degree Celsius ) Working on undertaking – which may be subjective by the propensity of my activities vitamin D ) Communication – utilizing linguistic communication of chance vitamin E ) Attitudes – which may be influenced by the context of the job The model for my formative appraisal was based on appraisal schemes adopted by the APU. I had considered merely those schemes which I thought would reassign easy into the schoolroom for naming or measuring the accomplishment of single students. Module Handouts Consumer Protection Law

Question: Discuss about the Module Handouts for Consumer Protection Law. Answer: Introduction Industrial safety, considered under occupational safety and health, is the management of all activities and occurrences within an industry utilised to protect employees as well as other assets(Safeopedia, 2017). Industrial safety measures risks and potential accidents are minimised through the compliance of relevant laws and regulations. Accidents are undesired, unintended, identifiable and separate events or incidents that are likely to cause physical injury, in this case to employees or people at the workplace(Sharman, 2016). The Royal Decree 71/91 recognises an industrial injury aa an accident arising during the course of ones work or caused as a result of this work(1991). In Federal Supreme Court Case No 52/20 of 2009, the court held an employer responsible for the safety of the employee by providing equipment. This duty extends even to where employees opt not to wear the equipment as was the situation in this case; the employees in question failed to return their protective gear and the deceased in question had failed to follow stipulated instructions to correctly install scaffolding. The court still held the employer liable(Grose, 2016, p. 61). Cases such as these and many others illustrate the significance of industrial safety and the gravity of the duty placed on employers to ensure their employees work in a safe environment. The concept of industrial safety is important as it ensures human life is protected especially in industries that are considered high-risk for example the mining industry, chemical industries among others(Moraru, et al., 2014). The maintenance of safe and healthy work environments is critical to employee relations but most importantly a legal requirement to be adhered to. Regardless of whether an employee is a seasoned veteran or an entry level worker, it is important for the company to ensure they understand the potential risks to their health and safety while at the work place. This ensures they are well equipped with knowledge to mitigate any arising issues(Moraru, et al., 2014). Additionally, as a legal requirement, it is important for organisations to have safety measures in place so as to avoid future litigation or penalties for non-compliance. Industrial safety is of advantage to employees as they are able to find recourse should they suffer an accident at work. An Overview of the legal issues arising In a workplace safety case, the first issue to consider is the relationship between the injured person and the organisation in question; that is whether they are an employee or not. Additionally, the industry in itself will determine whether any safety equipment was to be provided and if so whether it was in fact provided. Another possible legal issue would be to consider causation as this determines blame; that is identifying the cause of the accident or the circumstances leading to the accident so as to determine liability. With regard to liability there are various other issues to consider, firstly did the injured employees actions or omissions contribute in any way to his injury, or did the actions or omissions of another employee cause the injury. It is also important to determine the liability of the company where the injury has been caused by another one of its employees. The occurrence of most accidents has been credited to weak control systems within an organisation; for exa mple where a worker falls off a ladder at work as it slips from under him. An investigation unearths that the one of the rubber feet on the ladder is missing, this goes to show the ladder was not properly maintained; a weakness in the control system led to an personal injury. The majority of workplace accidents have been noted to arise from or involve mechanised equipment(Franck Franck, 2013, p. 229). As a worker at Al Maya Packaging Plant, Yusuf was entitled to certain security measures from his employer as required by law. However technical difficulties led him to suffer injuries as he tried to fix a jam in the machine. The incident has had lasting effects on Yusuf and his career as he lives in occasional pain, has lost his fingertips and also cannot carry out the chores he previously did at work. In the case of Yusuf the legal issues arising are; firstly whether the company followed the legal provisions under Oman Labour Law with regard to industrial safety. Secondly, whether Yusuf, as an employee, was provided the right equipment as well as instructions prior to beginning the assigned task. Additionally, the liability of Al Maya Packaging plant for Yusufs injury and if they are liable to compensate him in any way is in question. The liability of the employee who turned on the machine is also in question and whether Yusuf himself carries any liability by placing his hand in the machine; this will serve to determine whether the workers failed to follow instructions and wear the appropriate equipment. The law governing occupational health and safety in Oman In Oman, the laws regulating occupational health and safety are contained in the Royal Decree 35/2003 promulgating the Oman Labour Law; and the Ministerial Decision 286/2008 the Regulation of Occupational Safety and Health for the Establishments. However the general laws governing Omans occupational safety are similar to those applied around the world in other jurisdictions. The Ministry of Manpower (MOM), is the authority tasked with the mandate of looking over health and safety matters in the country and ensuring companies adhere to the regulations. Its powers include the authority to; investigate breach in duty and regulations; fine any organizations found in breach of the existing laws; where the breach is great the Ministry may take measures to foresee its closure, fully or partially, require that nay equipment suspected to contribute to health and safety risks is suspended until compliance is met and refer any violations of law discovered in the investigation process to the Ro yal Oman Police for action. By virtue that Yusuf was a worker at Al Maya packaging plant, it is clear that the company has a duty of care bestowed on it by law to ensure his safety on its premises at all times. This duty involves ensuring he is provided with adequate safety equipment and having regulations in place, set at a conspicuous area, to ensure all workers are aware on how to ensure they are safe while they go about their duties. The plant also has a duty to provide necessary training that may be detrimental to employee safety; that includes teaching them how to operate the machinery and ensuring they are aware of the risks involved and how to mitigate them. The following discussion will outline the provisions of law that cater to these issues and the liability of all the parties involved. Issue: Justification that Al Maya plant did not follow the legal provisions outlined in Oman Labour Law with regard to industrial safety; it failed to provide safety equipment and proper instructions. The Royal Decree 35/2003 provides for the duty of an employer under article 87 to ensure all employees are aware of the possible hazards accompanying their occupation and the protective measures available to them(MOM, 2003, p. 31). This duty includes the duty to ensure the machines and equipment provided are maintained and in the best condition. However, the duty to provide instructions and safety equipment does not displace the employers liability or responsibility should the employee fail to comply with these instructions and suffer an injury in the process. This was the holding of the court in the Federal Supreme Court Case No 52/20 where the failure of employees to follow instructions had led to the death of one of them, the court held that the employer was still liable as the provisions of the labour law were mandatory(Grose, 2016, p. 61). Article 18, Chapter 3 of the Ministerial decree 286/2008 also places the duty to ensure workplace safety on the employer by providing any necessary personal protective equipment. Prior to employment employers are tasked with ensuring that all workers are aware of any potential hazards as well as all protective measures they should undertake to ensure their safety(Oman, 2013). The contract of work on the other hand bestows a reasonable duty of care an diligence on employees to ensure they maintain and care for any work instruments or means of production placed at their disposal. Additionally, they are to abide by all and any safety and health regulations prescribed by law or by their employer. Yusuf has been identified as a full time worker, this is on the merit that he is said to usually arrive at work at eight in the morning, additionally the mention of a lunch break signals that he spends most of the day at the plant and as such is a full-time employee of Al Maya packaging plant. This relationship bestows certain obligations on Al Maya as the law described above requires that the company avail Yusuf with proper equipment and brief him on security measures to undertake at the workplace. Additionally, the case study mentions that on the day of the accident, Yusuf was placed on a new packaging line; it is the duty of the plant to ensure that Yusuf was provided the necessary support by way of equipment and instructions to safely undertake this new task. The law also provides that employers routinely check and maintain equipment as per the regulations provided by the Ministry and any other measures they deem fit so as to ensure they fulfil their duty of care to their employees. In this case, Al Maya is tasked with ensuring its packaging equipment is properly monitored and maintained; where machinery is problematic the duty of care would expect that a reasonable employer does not allow, or at least makes it known, to the employers on the unsafety of using it an endeavours to have it fixed as soon as possible. If the jam of the machine in this scenario has been a common occurrence, Al Maya is liable by virtue that they did not undertake the necessary measures to use it on time as well as to inform employees that it was faulty and possibly put it out of bounds, This illuminates a weakness in the companys control system for which it can be held liable as employee safety is compromised. Issue: justification of the liability of the employer and employee with regard to the accident. As previously mentioned, the provisions of safety law in Oman are not so much different as the practices employed the world over. In principle, as per article 176 of the Oman Civil Code, any harm caused to another renders the doer liable and as such they are tasked with making good the harm(Oman, 2013). Additionally, a person is considered vicariously liable for any actions causing harm to another by those persons under their supervision or control acting in their ordinary course of business under a master and servant relationship(Grose, 2016, p. 116). As held in the Dubai Cassation Nos 130/2003, an employer is vicariously liable for harm caused by his employees during the employment relationship regardless of the absence of actual control at the time the harm was committed. The principle of vicarious liability mentioned above places the liability of employees on employers if it occurs in the ordinary cause of business. As such, the actions of the employee who turned on the machine place the liability on the packaging plant as he was working as an employee and not on his own volition. He simply turned on the machine to continue his work as he should, However, if there are procedures in place that an employee should undertake that would have prevented the accident and the employee was aware but chose not to follow them then the employee will be held liable as he also has a duty to ensure the safety and care of himself, his co-workers and the equipment in the exercise of his duties. Furthermore, the law highlighted above provides that, regardless of whether the employees follow instructions or not, the employer is still liable to a certain extent and as such Al Maya packaging plant holds some liability over Yusufs injury. Issue: justification that Yusuf is liable to get compensation Once liability is found based on the above mentioned laws and precedents, the Sultans Decree No 40 of 1977 on Issuing the Compensation for Work Injuries and Professional Diseases comes into play. This decree provides that employees be compensated for any injury or disease suffered because of their work. Article 2 of this decree provides that employers undertake to insure themselves as well as their employees from any possible injuries or other circumstances described under the law. Additionally, Article 32 of the Act requires that should the injury leave the employee permanently disabled then the employee or his dependants should be compensated up to 36times his basic salary. Additionally, the Royal Decree No 71/91, provides for compensation for insured employees in the event of death or disability arising from a work place injury. This decree purposefully covers insurance against industrial injuries and diseases. Articles 20 and 21 of the decree task both employees and their employe rs with contributing a certain amount to their insurance scheme payable upon either termination of employment or retirement with interest. This insurance covers death or disability at work. According to Art 22, if the male insured workers services are terminated due to an industrial injury or death then the insurance should be paid to them or their beneficiaries subject to the contributions made. In Yusufs case, the injury caused him to lose his fingers; this has amounted to a disability that may cost him his job. The incident has left him in excruciating pain and unable to use his hand properly asking him unfit for this job. As liability has already been previously established, Al Maya packaging should be guided by the aforementioned provisions to ensure Yusuf is compensated as he is entitled under the law. The Royal Decree 40 of 1977 entitles Yusuf to compensation as it is expected that his employer undertook to insure him against any injuries or diseases suffered in the course of his duties. The injury has caused him permanent disability by virtue that he has lost fingertips and is always in pain; he ia therefore justifiably entitled to 36times his salary. Conclusion In conclusion therefore, Al Maya packaging is liable for Yusufs personal injury as well as the emotional damage arising from the loss of his fingertips and the future losses arising from his inability to work as he used to due to the pain he has to live with. This has been made clear by the provisions of law discussed above and the highlighted precedents. Regardless of the liability held by Yusuf or the other employee, Al Maya packaging still has a duty to exercise and as such, subject to its liability, should compensate Yusuf and his dependants accordingly.
